Terms of Service

These Terms of Service ("Terms") govern your use of the LAVA Discord bot ("LAVA," "the Bot," "we," "us"). By adding LAVA to a server, or using any of its commands, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use LAVA.

LAVA and this website (lavabot.site) are operated by Ghimici Denis-Constantin, an individual sole trader based in Romania ("we," "us," "our"). By using LAVA or purchasing a LAVA Premium subscription, you are entering into a contract with Ghimici Denis-Constantin.

LAVA is an independent, third-party bot. It is not affiliated with, endorsed by, or operated by Discord Inc. Your use of Discord itself is separately governed by Discord's Terms of Service, Community Guidelines, and Developer Policy.

1. What LAVA Does

LAVA offers:

  • Music — search, queue, and stream audio sourced from YouTube, Spotify, Apple Music, and SoundCloud through a self-hosted Lavalink audio server, plus filters, autoplay, and (for Premium servers) saved queues
  • Moderation — /ban, /kick, /mute, and /unmute for server staff, built on Discord's own moderation systems
  • Utility — bot info, help, bug reporting, and premium requests

Some commands require server-moderator permissions (e.g. Ban Members, Kick Members, Moderate Members); some require Premium status, granted at our discretion.

2. Eligibility

You need to meet Discord's own age and account requirements to use Discord — and, by extension, LAVA. Server owners and admins are responsible for only adding LAVA where that's appropriate under Discord's Community Guidelines.

3. Acceptable Use

You agree not to:

  • Use LAVA to violate Discord's Terms, Community Guidelines, or any applicable law
  • Attempt to abuse, overload, exploit, or reverse-engineer LAVA or its audio infrastructure
  • Use its moderation tools to harass, discriminate against, or unfairly target other users
  • Request or distribute, through LAVA, content you don't have the right to share

We may blacklist a server or restrict a user's access to LAVA, with or without notice, if we believe these Terms or Discord's policies are being violated.

4. Server Owner Responsibility

Your server's owners and admins are responsible for how LAVA is configured and used in your server, including who can access moderation commands. We aren't responsible for moderation decisions your own server staff make using LAVA's tools.

5. Music Content and Third-Party Platforms

LAVA doesn't host or store audio files. It resolves your search terms and links in real time against YouTube, Spotify, Apple Music, and SoundCloud, and streams the result to your voice channel.

  • We're not affiliated with YouTube/Google, Spotify, Apple, or SoundCloud.
  • Track availability depends on those platforms and can change or disappear without notice.
  • You're responsible for making sure you have the right to play requested content in your server. If you believe something played through LAVA infringes your rights, contact us (Section 13) — but since we don't host the underlying media, most takedown requests should go to the source platform directly.

6. Premium Features

Some features (like /savedqueue, unlimited queue, autoplay, priority support, and expanded platform support) require Premium status. Premium can be granted at our discretion via /requestpremium, or purchased as a paid LAVA Premium subscription on this website ($2.99/month per Discord server, billed monthly and auto-renewing until cancelled).

6a. Payments, Subscriptions, and Merchant of Record

Payments are processed by Stripe Payments Europe, Limited ("Stripe"). By purchasing LAVA Premium, you also agree to Stripe's Consumer Terms of Service and Privacy Policy, which govern the payment, billing, invoicing, and processing of your purchase. Prices are displayed at checkout and may be adjusted at renewal on reasonable notice. Applicable taxes, where enabled, are calculated at checkout.

Your subscription renews automatically for successive monthly terms at the then-current price until you cancel. You can cancel at any time from the "Manage subscription" link on the Premium page or by contacting us. Cancellation stops future renewals; access to Premium continues until the end of the current paid period unless a refund is issued. Refunds are handled as described in our Refund Policy.

We may suspend or terminate a Premium subscription (with or without a refund of the unused portion) for material breach of these Terms, non-payment, chargebacks, fraud, or security/abuse risk.

6b. Intellectual Property

LAVA, this website, and all associated software, source code (except portions we make available under an open-source license), documentation, branding, logo, and content are and remain the property of Ghimici Denis-Constantin (or its licensors) and are protected by copyright, trademark, and other intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use LAVA and, if applicable, LAVA Premium within your Discord server(s). You may not resell, redistribute, sublicense, reverse-engineer, or circumvent any technical limitations of LAVA, except to the extent expressly permitted by an applicable open-source license or by law. All rights not expressly granted to you are reserved.

7. Availability

LAVA is provided on a best-effort basis, with no guarantee it will always be available, bug-free, or compatible with every server setup. We may modify, suspend, or discontinue any feature — or LAVA entirely — at any time.

8. Disclaimer of Warranties

LAVA is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

To the fullest extent the law allows, LAVA's operator is not liable for indirect, incidental, or consequential damages arising from your use of, or inability to use, LAVA — including moderation decisions made by your own server staff, or content sourced from third-party music platforms.

10. Termination

We can remove LAVA from any server, or restrict any user's access, at any time — particularly in response to violations of these Terms, Discord's policies, or applicable law. You can remove LAVA from your server at any time.

11. Changes to These Terms

We may update these Terms as LAVA changes. Continuing to use LAVA after an update means you accept the revised Terms; material changes will be reflected by updating the date above.

12. Governing Law

These Terms are governed by the laws of Romania, without regard to conflict-of-law principles. This does not deprive you of any mandatory consumer-protection rights available to you where you live.
